The Vatican investigation into Pope Benedict XVI's 2013 resignation is still active, and the implications could be seismic. Italian journalist Andrea Cionci, the main complainant, was summoned for a second formal hearing on August 3, submitting an additional 50-page petition with new material. The Promoter of Justice has indicated the investigation is being taken seriously and may conclude in the near future.
At the center of the case is the claim that Benedict renounced only the active exercise of the papal office, not the Petrine munus itself—potentially invalidating the subsequent conclaves that elected Popes Francis and Leo XIV. If the resignation was invalid, the popes who followed would lack juridical standing.
A separate canonical study by former Italian magistrate Angelo Giordani challenges the 2025 conclave that elected Leo XIV, citing alleged irregularities: 133 cardinal electors despite the 120 maximum established by Universi Dominici Gregis, and reports of a cardinal with a mobile phone inside the conclave. Violations of the prescribed procedures could render the election null and void.
The Vatican investigation continues. It could end in dismissal, or in the opening of a formal trial. The outcome will determine whether the Church faces a crisis of legitimacy at the highest level. The faithful are watching. The stakes could not be higher.
